1. Acceptance of Terms

By creating an account or using Mythora in any way, you represent that you are at least 13 years of age (or 16 if you reside in the European Economic Area), that you have the legal capacity to enter into a binding agreement, and that you accept and agree to be bound by these Terms and our Privacy Policy.

2. Description of Service

Mythora is an AI-powered persistent world platform that allows users to create, explore, and interact within shared fantasy worlds generated and maintained by artificial intelligence. The service includes:

• World creation tools powered by generative AI.
• A map-based interface for exploration and interaction.
• Asynchronous multiplayer features enabling shared world experiences.
• Subscription plans providing access to premium features and higher usage limits.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must provide accurate, current, and complete information during registration and keep it up to date.
• You may not share your account or allow others to access the service through your credentials.
• You must notify us immediately at hello@mythora.app of any unauthorized use of your account.
• We reserve the right to terminate accounts that violate these Terms or are inactive for an extended period.

5. Prohibited Conduct

You agree not to:

• Use the service for any unlawful purpose or in violation of these Terms.
• Attempt to circumvent usage limits, rate limits, or subscription restrictions.
• Use automated scripts, bots, or scraping tools to access the service without prior written consent.
• Submit prompts designed to generate illegal, hateful, sexually explicit (involving minors), or otherwise harmful content.
• Attempt to reverse engineer, decompile, or extract the underlying AI models or proprietary algorithms.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Interfere with or disrupt the integrity or performance of the service or its underlying infrastructure.
• Use the service to train competing AI models or datasets without our explicit written permission.

Violation of this section may result in immediate account termination and, where appropriate, legal action.

6. Intellectual Property

The Mythora name, logo, platform design, and underlying technology are owned by Mythora and protected by intellectual property laws. Nothing in these Terms grants you a right to use our trademarks, trade names, or branding without our prior written consent.

You acknowledge that the service, including its AI systems, software, and infrastructure, is the exclusive property of Mythora and its licensors. You may not copy, modify, distribute, sell, or lease any part of the service.

7. Payments & Seeds

• Mythora uses a credit system called “Seeds.” Seeds are purchased as one-time packages and consumed when you take actions in the game (e.g., story turns, world creation, character revival).
• Payment processing depends on the platform you use to make the purchase:
  • Web: Payments are processed by Lemon Squeezy, our Merchant of Record. By purchasing Seeds on the web, you agree to Lemon Squeezy's terms and authorize the charge to your payment method.
  • iOS App (App Store): Payments are processed by Apple through the App Store. Apple's payment terms and conditions apply.
  • Android App (Google Play): Payments are processed by Google through Google Play. Google's payment terms and conditions apply.
• We reserve the right to change seed package pricing with 30 days' notice. Purchased Seeds remain valid regardless of pricing changes.
• Seeds have no monetary value outside of Mythora and cannot be transferred, traded, or exchanged for cash.

Refund Policy

Refund eligibility and processing depend on where you made the purchase.

Web purchases (Lemon Squeezy)

• Unused Seeds: Eligible for a full refund within 14 days of purchase.
• Partially Used: Pro-rated refund for unused Seeds within 14 days of purchase.
• Fully Consumed: Non-refundable.
• Refund requests can be submitted to hello@mythora.app. Refunds are processed within 5–10 business days via Lemon Squeezy.

iOS App Store purchases

• Refunds for purchases made through the iOS App are handled by Apple, not Mythora. Please submit a refund request at reportaproblem.apple.com.

Google Play purchases

• Refunds for purchases made through the Android App are handled by Google. Please submit a refund request through the Google Play Store within the eligible window defined by Google's refund policy.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that: (a) the service will be uninterrupted or error-free; (b) the results obtained from use of the service will be accurate or reliable; (c) AI-generated content will be appropriate, accurate, or suitable for any particular purpose.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYTHORA, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID TO MYTHORA IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless Mythora and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the service, your violation of these Terms, or your infringement of any third-party rights.

11. Termination

We may suspend or terminate your account and access to the service at our sole discretion, at any time, with or without cause, with or without notice. Grounds for termination include, but are not limited to, violation of these Terms, harmful behavior, or extended inactivity.

Upon termination, your right to use the service will immediately cease. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, indemnification, and limitation of liability) shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date and notify you via email or an in-app notice at least 14 days before the changes take effect. Your continued use of the service after the effective date constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the service.
